Following an investigation into alleged Code breaches made by a customer, the BCCC found that the bank:

  • breached the following 2013 Code obligations:
    • clause 12.1(a), 13.1, 13.2 and 13.3 (copies of documents), and
    • clause 3.2 (fair and reasonable conduct).
  • did not breach clause 3.1(e) (communicate in a timely manner).

This investigation was initiated by the Code Compliance Monitoring Committee (CCMC) in February 2019 and since 1 July 2019, the BCCC had carriage of the matter in accordance with its Charter.
